Who we are

This website, www.fractary.com (the "Site"), is operated by Jamnaytac LLC d/b/a The Fractary ("The Fractary," "we," "us"). You can reach us at hello@fractary.com.

Acceptance

By using the Site you agree to these Terms of Use. If you don't agree, please don't use the Site. We may update these terms from time to time. The current version is always posted here with its effective date.

Use of the Site

You may use the Site for lawful purposes only. Don't attempt to disrupt the Site, scrape it in a way that burdens our servers, misrepresent who you are when you submit a form, or use the Site to send spam or malicious code. We may block access to anyone who misuses the Site.

Content and intellectual property

Unless otherwise noted, the text, design, logos, and other original content on the Site are owned by The Fractary and protected by copyright and trademark law. You may link to the Site and quote brief excerpts with attribution, but you may not republish substantial portions without permission.

Our open-source platform tools, including Codex, Faber, Forge, and Helm, are published on GitHub under their own licenses, currently Apache-2.0 for the public repositories. Those licenses, not these terms, govern your use of the code.

The Stockyard is an index of third-party projects. Names, descriptions, code, and trademarks of listed projects belong to their respective owners. Listing a project doesn't mean we endorse it, and it doesn't grant you any rights in it beyond what its own license provides.

Third-party links

The Site links to third-party sites and services, including Stockyard listings on GitHub and elsewhere, the websites of our ventures, our community chat, and the form service we use for invite requests. We don't control those sites and aren't responsible for their content, availability, security, or privacy practices.

No warranties

The Site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. In particular, a "Verified" label in the Stockyard means a listing comes from an official or production-grade source. It is not a security review, a test result, or a guarantee that the project is safe or suitable for your use. Review any code before you run it.

Limitation of liability

To the fullest extent permitted by law, The Fractary and its members, managers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising out of or related to your use of the Site or anything linked from it, even if we've been advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

Changes

We may change or discontinue any part of the Site at any time without notice. We may revise these terms by posting a new version here. Continued use of the Site after a change means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute relating to these terms or the Site will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
